General Privacy Notice of BERILLION GmbH

1. What is this Privacy Notice about?

BERILLION GmbH and its affiliated companies process personal data in different ways and for different purposes. References to “we” or “us” in this document refer to BERILLION GmbH, unless otherwise specified (see section 2).

Personal data” means any information relating to an identified or identifiable natural person. “Processing” means any operation with such data, including collecting, storing, using, or disclosing it.

This Privacy Notice explains how and why we process personal data (hereinafter referred to as “personal data” or “data”) in the following situations:

  • when you visit our website www.invizcom.com,
  • when you make use of our services or products,
  • when you book an appointment with us via cal.com,
  • when you apply for a job with us

  • when you otherwise interact with us in the context of a contract,
  • when you subscribe to our newsletter,
  • when you otherwise interact with us in connection with our offers.

Although our services are generally aimed at companies (B2B), personal data of individuals is processed in the above contexts. This Privacy Notice informs you about such processing, how we protect your personal data, and what rights you have.

2. Who is responsible for processing your data?

For the processing described in this Privacy Notice, the following company is the “controller”, i.e. the party primarily responsible for complying with data protection law, unless otherwise stated:

If you are in direct contact with one of our affiliated companies, e.g. INVIZCOM GmbH in Germany, that company is considered to be the controller in the respective case.

3. What personal data do we process?

The categories of personal data processed depend on the specific situation. The most common categories are:

3.1 Master data

Basic identification and contact details, such as name, gender, age, address, email, telephone, company affiliation and professional details, authorizations and signatures.

3.2 Contract data

Information in connection with contracts and services, such as date and content of the contract,
information on services provided, billing and payment details, records of support requests or feedback.

3.3 Communication data

Information exchanged when contacting us name, contact details,
content of correspondence (email, forms, chat, social media), time and metadata of communication.

3.4 Technical data

When you visit our website, certain technical data is automatically collected IP address, browser type/version, operating system, referrer URL, date and time of access, accessed pages.

3.5 Other data

Depending on the circumstances, further data may be collected, e.g. job application data (CV, certificates, references), data in connection with events, photos or videos, information in the context of legal obligations.

4. For what purposes do we process your personal data?

We process your personal data primarily for the provision of our services and the fulfillment of contracts. In addition, we use the data for purposes such as:

  • Communication: responding to inquiries and maintaining business relationships.
  • Customer care and marketing: sending newsletters, targeted information, or invitations.
  • Appointment scheduling: processing your booking via cal.com.
  • Website optimization, IT security and fraud prevention.
  • Compliance with legal obligations.
  • Enforcement of legal claims or defense against claims.
  • Internal administration, accounting, archiving.

If we process data on the basis of your consent, you may revoke this consent at any time with effect for the future.

5. How do we process data on our website?

5.1 Technical data

We collect technical usage data to ensure stability and security, and to improve our website.

5.2 Cookies

5.3 Appointment booking with cal.com

When you book an appointment via cal.com (Cal.com Inc., San Francisco, USA), the data you enter (e.g. name, email, desired date) is transmitted to cal.com and processed there. For details, see cal.com’s privacy notice: https://cal.com/privacy.

6. Social media

If you interact with us on social media (LinkedIn, YouTube, etc.), the respective providers also process your data independently. We cannot influence this processing. Please consult the privacy notices of the respective platforms.

7. Who do we disclose your personal data to?

We may share your personal data with:

  • affiliated companies (e.g. INVIZCOM GmbH, Germany),
  • IT service providers, consultants, hosting providers,
  • authorities or courts if legally required,
  • third parties in the context of corporate transactions.

Service providers process data only within the scope of our instructions and are bound by data protection agreements.

8. Do we transfer personal data abroad?

Data may also be processed outside Switzerland and the EU/EEA, e.g. in the USA. If there is no adequate level of protection, we ensure this through appropriate safeguards such as EU Standard Contractual Clauses or obtain your explicit consent.

9. How long do we process your data?

We store personal data only as long as necessary for the purpose of processing or as long as there is a legal retention obligation. For example:

  • contract data: usually 10 years,
  • communication data: usually 10 years,
  • marketing data: shorter, generally 2 years after last contact,
  • technical data (log files): up to 5 years.

10. What is the legal basis for processing?

Depending on the applicable law (Swiss DSG, GDPR), processing is based on:

  • your consent (Art. 6(1)(a) GDPR),
  • contract fulfillment (Art. 6(1)(b) GDPR),
  • legal obligations (Art. 6(1)(c) GDPR),
  • legitimate interests (Art. 6 Abs. 1 lit. f DSGVO), such as IT security, marketing, legal defense.

11. How do we protect your data?

We apply appropriate technical and organizational measures to protect personal data against unauthorized access, misuse, loss, or destruction. However, no system is completely secure and residual risks remain.

12. What rights do you have?

You have the following rights under applicable law:

  • Right of access to your data,
  • Right to rectification,
  • Right to erasure,
  • Right to restriction of processing,
  • Right to data portability,
  • Right to object to processing,
  • Right to withdraw consent at any time.
